PetLynx Corporation and its affiliates ("PetLynx" or "we") provide the content of the Urban Animal Surveys (UAS) to prepaid subscribers subject to the following terms and conditions (the "Terms") which are updated periodically at the sole discretion of PetLynx Corporation. By purchasing the UAS you are agreeing to these Terms. Copyright
All content of the UAS, including text, logos, images and data, is the exclusive property of PetLynx and is protected by Canadian and international copyright laws. All rights not expressly granted are reserved.
Trademarks
The trademarks, designs and logos displayed on the UAS are the registered and unregistered Trademarks of PetLynx Corporation. You agree that you will not refer to or attribute any information to PetLynx in any public medium for advertising or promotion purposes, or for the purpose of informing or influencing any third party and that you will not use or reproduce any Trademark of, or imply any endorsement by or relationship with, PetLynx without prior written permission.
Purpose
The purpose of distributing resources such as the Urban Animal Survey to SUAS alumni is to equip and resource these executive leaders to be agents of change and subject matter experts within their communities and this industry. The UAS may also be used by commercial subscribers for internal planning and market research purposes only. This survey may not be used as part of any product or service being sold to a third party. You may make a reasonable number of copies of the UAS and each copy will be subject to the Terms of Use conveyed to you upon purchase of the original copy. Finally, you agree to secure these electronic files and printed materials from uses other than those intended.
Subscriptions
A yearly subscription to the Canadian Report is $3,500 CA and a yearly subsription to the US Report is $4,250 CA. These subscriptions have a restricted right of use as per these Terms and Conditions.
PetLynx Credit Voucher Programs
Certain PetLynx clients receive credit vouchers that may be applied to their purchase of surveys and other PetLynx ECOMM products and services. Vouchers provided under this PetLynx program must be used within the program period specified on each voucher. PetLynx vouchers are intended to recognize client loyalty but have no cash value. PetLynx accepts no liability for errors or omissions and for vouchers which are not used within the program period.
Restrictions on Use of Content
Your organization must prepay your subscription based on the price and category, as detailed in these terms of use. Upon purchase of the UAS, you are granted a non-exclusive, non-transferrable right for the non-commercial use of the data contained in the UAS. You agree not to modify the UAS content in any way and to retain all copyright and other proprietary notices displayed. You may not otherwise resell, reproduce, distribute, transmit, post or disclose the UAS content, or any part thereof, without the prior written approval of PetLynx Corporation. The UAS will ONLY be made available to you electronically. You also agree to bind employees or stakeholders of your organization who use this information into compliance with this Terms of Use.
Payment terms
Prepaid subscriptions must be received by 15 August of each calendar year. Subscription applications received after 15 August have a $500 surcharge.
Disclaimers
Subscribers are cautioned that this information may not be suitable for the purpose they have in mind. PetLynx provides this information on an exceptions and omissions excepted basis. PetLynx does not undertake to update this information if changes in the market place occur whether foreseen or not.
Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of Alberta, Canada.
